Falcon Elevators shall not be liable for any damages arising out of or in connection with the use of this website. This limitation of liability applies to all damages of any kind, including but not limited to direct, indirect, incidental, punitive, and consequential damages.1.That the party of the First Part shall made the payment of the elevators to the account of Falcon Elevators through banking channel.
2. The Contractor shall be responsible for the furnishing of all labour and tools for the supply, delivery, installation, testing, loading, unloading of the elevators and other equipment’s and commissioning of the Elevator.
3. The work will be executed strictly according to speculations and drawings relating to the work as shown in the architectural documents/or as per site and design drawings and the contractor hereby agreed with party of the First Part to execute the work in conformity in all respects with the provisions of the agreement.
4. The Party of the First Part hereby agreed to pay the contractor, in consideration of will release payment to the contractor in respect of completed work, or item of work, according to the schedule of payments which is attached with quotation with this agreement.
5. The time allowed for completion and installation of work is 3 months commencing from the date of Advance Payment.
6. That if the Contractor fails to complete the works to the satisfaction of Party of the First Part or as per the drawings/or as per site, within the said period of 4 months specified as above the Contractor shall pay to the Party of the First Part as damages of rupees Two Thousand Rupees per day till the work not completed.
7. Contractor shall fully guarantee all work performed during the Term of the Contract and should the Owner determine during the term or within thirty (30) days after termination that any required work has not been fully performed, has been performed improperly or not performed at all, the Contractor shall, after written notification by the Owner correct said deficiency within ten (10) days. Failure to correct will be construed as a default under the Contract and the Owner has the right to secure others to perform the services and deduct the costs of these services from the contractual amount due to the Contractor under this Agreement.
8. The Contractor agrees that all work shall be performed by and under the supervision of a sufficient number of skilled, experienced elevator service mechanics and repairmen directly employed by Contractor, who are permanently assigned to support the execution of this Contract for maintenance and repair work and who shall be qualified to keep the elevators properly adjusted and/or repaired all personnel shall be employees of the Contractor. The Contractor and its employees shall use all reasonable care to maintain the elevator equipment in proper and safe operating condition. All employees performing work under this Contract shall be satisfactorily dressed in clean uniforms (identifying them as elevator service personnel). Any employees found to be unacceptable to the owner shall be replaced after being given reasonable notice by the Contractor. All employees are subject to security screening upon entering and/or exiting the Owner property.
9. Contractor agrees that the services to be provided by Contractor under this Contract are to be rendered by Contractor as an independent contractor, and that Owner is to have no responsibility for the acts of, bodily injury to, death of, or loss of employment by Contractor or Contractor's agents or employees or representatives, and Contractor will indemnify and hold harmless all Indemnified Parties from any and all Damages with respect to any and all claims for bodily injury or death or property loss or damage arising out of or attributable to performance by Contractor under this Contract.
10. That the Owner shall hire from the contractor One Trained Lift operator for the operations of elevator after its installation for smooth operations.
11. The Contractor's personnel shall check in with the Owner representative and sign in log book prior to commencing work and check out after completing the work. This requirement applies to regular maintenance, repair and callbacks.
12. At time of check-in, Owner/Agent’s representative shall provide Contractor's personnel with a list of any reported problems requiring the Contractor's attention.
13. That the completion time agreed will be excluding the national holidays, strike holidays and any unforeseen holidays.
14. Delay in civil works and payment will result in delay in work completion.
15. If, the contractor is bound to follow the PPE’s and get day to day Work permit at site, additional 15 days will be required to complete the work .
16. Incase the site completion is delayed from the client side, additional days will be required to complete the work. Different time zone will have different completion timelines. For this case ,30 days delay from client side will result in 10 days additional delay for work completion as labor is continuously being moved from site to site for fresh order. Similarly if the site under hold duration is 60 days from the client site the work will be completed within 20 days delay. And this delay days will continue to add till 365 days which will result in 120 days delay completion.
17. Any project on hold for more then 365 days and below 730 days will be considered as invalid and renewed if agreed by both the parties.
18. Incase of cancellation of order, 30% payment will be deducted from the paid amount and returned to the owner with in 75 days.
19. Incase of any issues are raised during the execution of the contract. Both the parties will move towards the arbitration.
20. Incase if matter is taken up legally after the failure or arbitration, the law of jurisdiction area is Lahore, Punjab, Pakistan.
21. The Owner shall provide single phase supply with in 30 feet radius of the elevator shaft at all floors.
22. If the location of site is other the Lahore, Islamabad and Multan, the owner will provide residence to the labor and staff working on site.
23. If the pit is filled with water and debris, the owner is responsible to get it cleaned.
24. The owner is responsible to provide proper access to the machine room, incase of any accident due to the improper access, the Owner will provide the medical expenses of the injured and will also pay any salary if the injured has to go for bed rest and its duration is decided mutually.
25. Incase of material is misplaced/theft from the site, the contractor upon furnishing of the gate pass and proof of delivery, will sign a supplementary contract, for which the payment will be made 100% in advance.
26. Incase of any additional requirement, a supplementary contract will be signed along with mentioning of the price and time required to execute the job and payment will be made 100% in advance.
27. Incase of default from the Falcon Elevators, after giving two written notices for period of 15 days each, client reserves the right to get the pending work completed from the ledger balance of Falcon Elevators.
